Terms and Conditions for SoftReis Mobile App

Welcome to the SoftReis mobile application (“App”), operated by SIER (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the SoftReis App, as well as any related services, content, and features (collectively referred to as the “Services”).

Please read these Terms carefully before using our App. By creating an account, downloading, or using the SoftReis App, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Services.

1. Acceptance of Terms

By accessing, downloading, or using the SoftReis App, you represent and warrant that:

• You are at least 18 years old, or you have reached the legal age of majority in your jurisdiction.
• You have the legal authority to accept these Terms and are capable of entering into a legally binding contract.
• You agree to comply with all applicable laws and regulations while using the App.

2. Account Registration

To access certain features of the App, such as using loyalty programs, uploading prescriptions, or booking appointments, you are required to create an account.

• Mandatory Information: To create an account, you must provide your Name and Email Address. Other information (such as NIF, address, phone number, and birth date) is optional but may be necessary for specific features.
• Accuracy of Information: You agree to provide accurate and complete information during registration and to update your information if it changes. Failure to maintain accurate information may result in termination of your account.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password). You are solely responsible for all activities conducted under your account.
• Multiple Accounts: You may not create more than one account without our prior written consent.

3. Use of Services

The SoftReis App provides users with several features, including:

• Access to exclusive discounts and offers at SoftReis pharmacy.
• The ability to upload medical prescriptions and retrieve them at a SoftReis pharmacy.
• Location services to find nearby pharmacies using OpenStreetMap.
• Booking appointments with health professionals at participating pharmacies.
• Managing loyalty programs, vouchers, and other promotional services.

By using the Services, you agree to the following conditions:

• Non-Commercial Use: You agree to use the App solely for personal, non-commercial purposes.
• Prohibited Conduct: You may not engage in any unlawful, harmful, or malicious activity on the App, including:
  • Using the App to infringe upon the rights of others.
  • Attempting to hack, exploit, or reverse-engineer any part of the App.
  • Uploading any harmful or malicious content (e.g., viruses, malware).
  • Misusing or manipulating any discount, referral, or loyalty program for unfair advantage.

4. Medical Prescriptions

The App allows you to upload medical prescriptions for fulfillment at SoftReis pharmacies. By using this feature, you agree to the following terms:

• Accuracy: You are responsible for ensuring that all uploaded prescriptions are accurate, valid, and current.
• Usage of Prescriptions: We may reject prescriptions if they are incomplete, incorrect, expired, or do not comply with local legal requirements.
• Storage: Uploaded prescriptions will be securely stored and used solely for the purpose of fulfilling orders at our pharmacies. Please refer to our Privacy Policy for more information on how we protect your data.

5. Payment and Invoices

When purchasing products or services through the App, the following terms apply:

• Payment: You agree to pay all applicable fees and charges for products or services ordered through the App.
• Invoices: We will provide electronic invoices for purchases made via the App. You are responsible for ensuring the accuracy of your payment information.
• Refunds: Any refunds for products or services purchased through the App will be subject to the refund policy of the pharmacy or service provider where the purchase was made.

6. Loyalty Programs, Discounts, and Vouchers

The App provides users with access to loyalty programs, discounts, and promotional vouchers. By participating, you agree to the following:

• Non-Transferable: Loyalty points, vouchers, and referral rewards are non-transferable and cannot be sold or exchanged for cash unless explicitly stated otherwise.
• Misuse: Any misuse of discounts, referral codes, or promotional offers may result in the suspension or termination of your account.
• Expiration: Vouchers and loyalty points may have expiration dates. It is your responsibility to use them within the specified timeframe.

7. Referral Program

SoftReis may offer a referral program where you can earn rewards by referring new users to the App. The following conditions apply:

• Eligibility: To participate, both the referring user and the referred user must meet the eligibility requirements for the App.
• Misuse: You may not create fake accounts or use self-referrals to gain rewards unfairly.
• Limitations: We reserve the right to modify or terminate the referral program at any time without notice.

8. Third-Party Services

The App may contain links to third-party services, such as pharmacies, medical professionals, or payment processors. We do not control, endorse, or take responsibility for third-party services.

• Use of Third-Party Services: Your use of third-party services is subject to their own terms and conditions. We are not liable for any issues or disputes arising from your interactions with third-party services.

9. Intellectual Property

The content, design, logos, trademarks, and other intellectual property found on the App are owned by us or our licensors and are protected under applicable intellectual property laws.

• License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, distribute, or create derivative works based on the content of the App without our express written permission.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice, for reasons including, but not limited to:

• Breach of these Terms.
• Engaging in fraudulent or unlawful activities.
• Misuse of discounts, referral codes, or loyalty programs.
• Failure to provide accurate account information.

Upon termination, your right to use the App and its Services will immediately cease, and we may delete or deactivate your account.

11. Disclaimer of Warranties

The SoftReis App and its Services are provided on an "as is" and "as available" basis. We make no warranties or representations regarding the availability, accuracy, or reliability of the App, and we expressly disclaim:

• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Any responsibility for the loss of data or personal injury resulting from your use of the App.

12. Limitation of Liability

To the fullest extent permitted by law, SoftReis, its affiliates, directors, employees, or agents will not be liable for any indirect, incidental, punitive, or consequential damages arising out of or related to your use of the App, including but not limited to:

• Loss of data, loss of profits, or loss of goodwill.
• Unauthorized access to or alteration of your transmissions or data.
• Any other damages or liabilities resulting from your use of third-party services through the App.

13. Indemnification

You agree to indemnify and hold harmless SoftReis, its affiliates, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the App, including but not limited to:

• Your violation of these Terms.
• Your misuse of the Services or violation of any law or the rights of any third party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts located in Portugal.

15. Changes to These Terms

We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be posted on this page, and we will notify you of significant changes through the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
